Duchemin had leased a house to Berthout, who abandoned it before the lease expired and allegedly took some furniture. They reached a settlement where Berthout acknowledged owing 9 livres 10 sols (of which he claimed to have paid 55 sols already), agreed to return the furniture, and Duchemin regained the right to rent the house to others.18

Deed-Land28 Feb 1693/94Samuel Duchemin and Isaac Duchemin received approximately 75 acres of land in Westmoreland County, Virginia, from Malachai Peale on 28 Feb 1693/94. This is the first known record of Samuel and Isaac in Virginia and is found in the Westmoreland County Virginia Court Order Book (1690-98), page 119a, February 28, 1693:

"At a Court held for the sd. County the twenty Eight day of ffeby.1693 (Capt. Wm Pierce, Mr. Wm Horton, Capt. Thos. Gouct, Mr. Henry Rosse, Justices), Mr. Malachy Peele came into Court and acknowledged a Deed of sale of Land from him to Saml. Decymee & Isaac Decymee to bee his proper Act & Deed and the Lands & premesses thereby conveyed to bee the just right and Inheritance of the sd. Saml. and Isaac Decymee. Ordered the same be Recorded."23
Deed-Land1 Oct 1701Samuel Duchemin received 200 acres of land for 3,500 pounds of "good sound tobacco in caske" in Richmond County, Virginia, on 1 Oct 1701. His name was recorded as Samuel Duchemine. This land became part of King George County after 1721.24
LandGrant27 Feb 1705/06He was granted land for the importation of six persons into Virginia under the headright system on 27 Feb 1705/06 in Westmoreland County, Virginia. The persons transported were Henry Stapleton, William Mean, William Duff, Margrett Collins, Pierce Cale and Michaell Spiller. This claim was not fulfilled until 1714.25
LandGrant18 Dec 1710He was granted 440 acres escheat land on 18 Dec 1710 in Upper Machotique, Westmoreland County, Virginia. His name was recorded as Samuel Duchiminia.26
LandGrant30 Aug 1711He was granted 202 acres on the lower side of the Occoquan River at the mouth of Broad Run on 30 Aug 1711 in Stafford County, Virginia. His name was recorded as Samuel Duchiminia. After Samuel's death, son John inherited this land, and it passed to John's widow Frances after John's death in 1739. Frances sold the land to Samuel Davis in 1740.27,28

In his will, Samuel Dishman (d. 1726) left his land in Essex County to his sons David and Peter, to be equally divided. David did not take possession of his share of the land, and Peter maintained possession of the entire property. David died without mentioning the land in his will. David's heirs sued Peter's son Samuel, who was then in possession of the land, for their share.36

Probable birth order based upon order named in will and estimated dates:

c 1697 - Samuel Jr.

Samuel Jr. is assumed to be the first born son since he was named after his father. A Westmoreland court judged a slave owned by Samuel Jr to be 7 yrs old on 27 Aug 1718. If we assume Samuel had to be 21 to own property, then he was born before 1697.

c 1700 - John

John is named as the eldest son in Samuel's will. Samuel Jr. is not listed and is assumed to have died, so this places John as the second born son. He was at least 21 years old when his father wrote his will in 1726, so he was born before 1705.

c 1702 - Elizabeth

Elizabeth was married at the time her father wrote his will in 1726 and is named second, so assuming she was at least 18 when married, she would have been born before 1708.

c 1704 - Anne

Anne was unmarried in 1726 when her father wrote his will and is mentioned third, and unlike sister Mary the will does not mention withholding her inheritance until she turns 18 or gets married, so she is assumed to be older than 18 in 1726 and would have been born before 1708.

1712 - James

James is mentioned fourth in the will. James' age is given as 84 or there abouts in a deposition dated 1796, so his birth year is placed at 1712. He also petitioned the Westmoreland court on 29 May 1733 for his share of his father's estate, so he must have turned 21 just before that date.

c 1714 - David

David is mentioned fifth in the will. David chose Original Brown as guardian in Feb 1729/30 when his mother Cornelia died. He was mentioned as a guardian in Sep 1733. Children could select their own guardian between ages of 14 and 21. This places birth date between 1712 and 1716.

c 1718 - Peter

Peter is mentioned sixth in the will. Peter chose brother David as his guardian in Westmoreland county on 2 Nov 1739, so he was less than 21 years old. This means he was younger than David, and was born after 1718.

c 1719 - Mary

Mary is mentioned last in the will. The will withholds her inheritance until she turns 18 or marries. Since she is unmarried in 1726 she would have been born after 1708. If she was born after Peter she would be born after 1718.

Note about references to the "late Samuel".

According to source 1762, Samuel was alive in Tinchebray, France (he signed, with his distinctive signature, a document concerning the lease of a house).

Source 1763 (dated 26 Mar 1692) refers to Judith Duchemin as the daughter of the "late Samuel".

Similarly, source 1764 (dated 17 Oct 1695) refers to Judith and Marie Duchemin as daughters of "late Samuel".

We have a large amount of circumstantial evidence that Samuel and his half-brother Isaac are living in Virginia by 1693 so what can explain this discrepancy?

Theory 1

Samuel Duchemin actually has died in France between 21 Nov 1691 and 26 Mar 1692. The Samuel Duchemin of Tinchebray is not the same person that appears in the records of Virginia between 1693 and 1726. This is difficult to prove because there are no known extant records in France recording the death of Samuel Duchemin of Tinchebray (unlikely to exist for French Protestants). The book Tinchebray et sa région, Au bocage normand by L'abbé L.-V. Dumaine, published in 1887, states (without providing his source) that Samuel and Isaac Duchemin were among the French Protestants that emigrated from the village of Landisacq (near Tinchebray). No other references to Samuel and Isaac Duchemin have been identified that indicate there were two Samuel Duchemins living in the Tinchebray area.

Theory 2

Samuel's family that remained behind in France claimed that he was deceased to hide the fact that he had emigrated. This may have allowed them to carry on their normal affairs without angering the Catholic Church, or to enable them to gain control of his estate.

Theory 3

Samuel's family (all or just a few) that remained behind actually believed he was deceased and acted accordingly.

I believe that Theory 2 or 3 are the most likely.

While Sheriff, he used the juror room at the county courthouse as his office, which means he did not have use of the office when a jury trial was being conducted. Shortly after taking office, the state condemned the jail building and he had to make arrangements with the nearby town of Fredericksburg to house his prisoners for the remainder of the term. He initially worked alone, but was allowed to hire a part time deputy starting in 1944. He purchased a second-hand radio with $100 of his own money and installed it in his car. During his career as Sheriff no serious crimes occurred in the county, mainly only misdemeanors and other petty crimes. He frequently pulled over speeders, and among the people he stopped were the Reverend Michaux, and famous radio evangelist from Washington, and State Senator Robert O. Lowery. He let the Reverend go with a warning, but gave the Senator a ticket.14

Research Note

Comment by James D. Dishman on 29 Dec 2001: "The book (King George County Marriages, Vol. 1) lists William's 1st and 3rd marriage, but not the second. There is over a 10 year period that the marriage records are missing in Westmoreland County and this is the period that William would have married Jane W. Cannaday. The name Jane W. is proved by the records but the name Cannaday does not appear. I determined that she was a Cannaday from a letter written by her son and our ancestor John Dishman to his half brother William Dishman (Jr) who was then living in Washington County, Va., dated 1836 in which he made reference to "Uncle Rubin" and the records proved that there was a Reuben Cannaday. Not the best of evidence but better than none."

1797 Westmoreland County deed has William Dishman and Jane his wife selling 6 acres to Theodore Wills.

Marriage record of William Deatley and Susan (Dishman) White, 28 Jan 1858, Westmoreland, lists Susan's parents as ___ and Jane Dishman. Jane is believed to be her grandmother Jane W. Cannaday Dishman whose name was given to possibly hide the fact that her mother Lucinda Dishman was possibly unmarried at the time of Susan's birth.

Death record of son John T. Dishman (d.1866) lists parents as Wm. and J. W. Dishman.

The name Jane W. is proved by the records but the name Cannaday does not appear. James D. Dishman determined that she was a Cannaday from a letter written by her son John Dishman to his half brother William Dishman, who was then living in Washington County, Va., dated 1836 in which he made reference to "Uncle Ruben".
